Order on Motion for Extension of Time
PAPERLESS ORDER. THIS CAUSE came before the Court upon the Byers Plaintiffs' Motion for Leave to File Out of Time Their Motion for Leave for an Extension of Time to Effect Service of Process Under Federal Rule of Civil Procedure 4(m). 1149 . Therein, Plaintiffs seek leave to file their Motion for an Extension of Time to Effect Service of Process Under Federal Rule of Civil Procedure 4(m) (the "Extension Motion") (ECF No. 1149-2) out of time due to excusable neglect. See (ECF No. 1149) at 2. In support thereof, Plaintiffs contend that they inadvertently filed the Extension Motion on the JPML docket on August 11, 2026, because they "had not yet received login credentials to electronically file in the Southern District of Florida MDL docket." See id. Defendants "take no position" on the Motion, but request that "briefing and consideration of [the Extension Motion] be stayed along with the rest of this action." See (ECF No. 1153) at 2. Plaintiffs agree that, once filed, the Extension Motion may be held in abeyance until further order of the Court. See (ECF No. 1158) at 1-2. Federal Rule of Civil Procedure 6(b) provides that "the court may, for good cause, extend the time... on motion made after the time has expired if the party failed to act because of excusable neglect." Fed. R. Civ. P. 6(b)(1). Here, the Court finds that Plaintiffs have demonstrated excusable neglect. Accordingly, UPON CONSIDERATION of the Motion, the pertinent portions of the record, and being otherwise fully advised in the premises, it is hereby ORDERED AND ADJUDGED that the Motion 1149 is GRANTED. Plaintiffs shall separately file the Extension Motion on the docket on or before October 13, 2026. Upon filing, the Extension Motion shall be held in abeyance pending further order of the Court.
