AMENDED CASE MANAGEMENT PLAN: The Court held a telephone conference on September 11, 2026 (the "Conference") to discuss the parties' conflicting proposed case management plans. (Dkt. Nos. 36-37 (the "PCMPs"); 38). Following the Conference, the Court ORDERS the following: 1. Should the parties wish to order a copy of the Conference transcript, they may do so by using the annexed form. 2. As discussed at the Conference, the Court declines to adopt either of the PCMPs. Instead, the Court sets the following discovery schedule: a. Requests for admission must be served by November 18, 2026. b. All fact discovery, including fact witness depositions, shall be completed by December 18, 2026. c. The parties shall file a letter certifying the completion of fact discovery by December 28, 2026. d. All expert discovery, including expert depositions, shall be completed by February 12, 2027. e. The parties shall file a letter certifying the completion of expert discovery by February 19, 2027. 3. By October 9, 2026, the parties shall file a joint letter limited to 1,050 words setting forth the status of discovery and identifying any issues ripe for the Court's attention. 4. Another telephone conference to discuss the status of discovery is scheduled for October 14, 2026 at 10:00 a.m. ET on the Court's conference line. The parties are directed to call (855) 244-8681; access code: 2308 226 4654, at the scheduled time. The Clerk of Court is respectfully directed to close Dkt. No. 37.
