OPINION & ORDER re: 54 MOTION to Dismiss Fourth Amended Complaint filed by Yonkers Public Schools. For the reasons set forth above, the Court grants the Motion as to all claims except the discrimination claims concerning Plaintiff s exclusion from the P-Tech program (with the limitations her election of remedies imposes on her state-law claim). Because the Court's previous Order and Defendant's pre-motion letters gave Plaintiff notice of the deficiencies in the Fourth Amended Complaint, which are the same as those in the Third Amended Complaint, the Court does not grant leave to amend a fifth time. See Smith v. Yoto, Inc., No. 25-CV-295, 2026 WL 1031269, at *20 (S.D.N.Y. Apr. 16, 2026). The Clerk of the Court is respectfully directed to terminate the pending Motion at Dkt. No. 54. SO ORDERED.
