Order on Motion to Intervene
PAPERLESS ORDER striking 39 Viktor Restis's Amended Motion to Intervene (the "Motion"). The Motion's certificate of conferral is insufficient under Rule 7.1(a)(3). Rule 7.1(a)(3) requires Counsel for Restis to make "a good faith effort to resolve by agreement the issues to be raised in the motion," not just to confer regarding the mere filing of the motion on the docket. See S.D. Fla. L.R. 7.1(a)(3). On or before June 30, 2026, Restis shall have one final opportunity to file a renewed motion to intervene that fully complies with all relevant federal and local rules. The certificate of conferral must show that the parties "act[ed] in good faith in attempting to resolve the dispute" and detail any agreement (or lack thereof) to resolve the issues raised in the motion. See S.D. Fla. L.R. 7.1(a)(3). Signed by Judge Aileen M. Cannon on 6/24/2026. (nct)
