MINUTE entry before the Honorable M. David Weisman: Magistrate status hearing held. 30(b)(6) deposition has been completed with some lingering time for completion. Discussion about relevance of Defendant's operating agreement, which Plaintiff seeks. The Court finds that evidence of Defendant's corporate structure is relevant, but not necessarily the operating agreement. The Court orders Defendant to provide an affidavit on Defendant's corporate structure and ownership. The Court will revisit the operating agreement itself at a later date if necessary. With respect to whether the underlying documents used to create the "cheat sheet" used during the deposition, Plaintiff shall file a motion (limited to up to 5 pages) on the issue by 10/14/26, Plaintiff to respond by 10/21/26. The Court will rule by mail by 10/28/26. As to documents relating to the closure of Plaintiff's Southard, OK plant, for the reasons explained in open court, the Court denies Defendant's request for further discovery on this issue. In summary, the issue was identified prior to the Rule 30 (b)(6) deposition and thus focused questioning could have occurred; the answers to the questions provided appear to provide a sound business reason for its closure; and the deposition answers did not suggest that there was an ulterior, unarticulated reason for its closure.
