ENDORSED ORDER denying in part and denying as moot in part 45 Plaintiff's Unopposed Motion to Approve Mediator, and Motion for Leave to Attend Mediation by Videoconference. To the extent that Plaintiff asks for approval of a non-certified mediator, the request is DENIED for failure to establish good cause. While the Court does not doubt Judge Thornton's experience, merely stating that the parties jointly request a non-certified mediator and their mediator of choice would spare travel expenses, particularly where the Court has already granted leave for the mediation to proceed remotely, see Doc. Nos. 42-43, does not good cause make. To the extent that Plaintiff again asks to conduct the mediation by videoconference, the request is DENIED as moot, as the Court has already granted that relief, see Doc. No. 43. It is ORDERED that within fourteen (14) days of the date of this Order, the parties shall select a mediator from the Court's list of certified mediators, and file a notice of mediation setting forth the name of the certified mediator, as well as the date of the parties' mediation, which shall occur by September 14, 2027, see Doc.
