ORDER granting Motion to Amend 23 . In the interests of efficiency and as an exercise of the Courts discretion, Plaintiffs are granted leave to file their Amended Complaint and are directed to do so by September 14, 2026. The Court will deem the pending motion to dismiss 18 to be made against the Amended Complaint and will consider all briefing by the parties on both the motion to dismiss and the motion to amend as it applies to the Amended Complaint. Accordingly, Defendant need not answer or otherwise respond to the Amended Complaint at this time. If any party wishes to submit supplemental briefing for the Court's consideration in connection with the motion to dismiss the Amended Complaint, it may file a letter brief by September 18, 2026.
