MINUTE entry before the Honorable M. David Weisman: The Court has reviewed the parties' joint status report indicating that Defendants Baker and Barnes and Dr. Kroll continue to discuss Dr. Kroll's response to Baker and Barnes' subpoenas (although at a painfully slow pace); the parties are continuing to pursue responses to other third-party subpoenas; Plaintiff Melissa Russell's deposition remains set for August 12, 2026; and the parties continue to confer regarding the sequencing of party depositions and Rule 30(b)(6) discovery. Status hearing set for 8/5/26 is stricken and reset to 9/16/26 at 9:15 a.m. Joint status report due by noon on 9/14/26 with a status of all outstanding issues; a list of all anticipated depositions with tentative dates; and any other issues the parties wish to raise. The parties shall continue to diligently pursue responses to third-party subpoenas; the Court expects that all subpoena responses will have been received by the next status hearing. Any motion to compel subpoena responses shall be filed by 9/11/26 and noticed for 9/16/26 at 9:15 a.m. Defendants Baker and Barnes shall provide a proposed affidavit of completeness to Dr. Kroll by 8/10/26; the parties shall continue to meet and confer as necessary to resolve this issue. The parties shall continue to meet and confer about depositions and begin diligently scheduling those depositions. The parties' proposed fact discovery completion date of 1/29/27 is taken under consideration and will be discussed at the next status hearing.
