Order Dismissing Case
MEMORANDUM ORDER (Granting Defendants' Motions to Dismiss; Granting Plaintiffs' Motion for Leave to File Limited Sur-reply; Denying Plaintiffs' Motion for Leave to Amend) - For the reasons set forth above, the Court resolves the pending motions as follows. The Court GRANTS Plaintiffs' Motion for Leave to File a Surreply (ECF No. 19 ). The Court DENIES Plaintiffs' Motion for Leave to File a Second Amended Complaint (ECF No. 31 ) as futile. The Court GRANTS the Gregory Motion (ECF No. 26 ) and DISMISSES Count VI against Sheriff Gregory WITH PREJUDICE. The Court further GRANTS the County Motion (ECF No. 9 ) in its entirety and DISMISSES WITH PREJUDICE all of Plaintiffs' claims against the County Defendants. Because the Court has already permitted Plaintiffs to amend once and has denied further leave to amend as futile, the Court will not permit Plaintiffs to further amend their pleadings. As the Court does not grant leave to amend, this Order qualifies as final and appealable. Should Plaintiffs desire to appeal, written notice of appeal must be filed with the Clerk within thirty (30) days of the date of entry hereof. Failure to file a notice of appeal within that period may result in the loss of the right to appeal. Fed. R. App. P. 4. The Court DIRECTS the Clerk's Office to close this case.
