AGREED ORDER REGARDING MARTIN'S PETERBILT OF WEST VIRGINIA, INC.'S POSITION CONCERNING THE "AMENDED VERIFIED PETITION: (I) FOR WRIT OF CERTIORARI; (II) FOR DECLARATORY JUDGMENT; AND (III) RELATED TO VIOLATION OF DUE PROCESS UNDER THE FOURTEENTH AMENDMENT OF THE UNITED STATES CONSTITUTION AND VIOLATION OF 42 U.S.C. §1983" directing that Respondent Martin's Peterbilt of West Virginia, Inc. has no position regarding the relief sought by Petitioners in their Amended Verified Petition attached to the 1 Notice of Removal, and that Respondent Martin's Peterbilt of West Virginia, Inc. shall not seek to intervene in this civil action, whether before this Court or any other court; further directing that Respondent Martin's Peterbilt of West Virginia, Inc. shall be, and hereby is, dismissed, with prejudice, as a respondent in this civil action; directing that Respondent Martin's Peterbilt of West Virginia, Inc. shall not be required to otherwise respond to the Amended Verified Petition.
