MINUTE entry before the Honorable Lindsay C. Jenkins: The Court has taken Plaintiff's motion for reconsideration under advisement. Having reviewed Plaintiff's memorandum of law in support of the motion, the Court informs the parties it intends to deny Plaintiff's motion to the extent it asks the Court to reconsider its conclusion that Drs. Dudycha, Kotecha, and Lee failed to base their causation opinions on sufficient facts or data (i.e., Section I(b) of Plaintiff's memorandum). While the Court will expand on its reasoning for the denial in its written ruling, it would prefer the parties focus their briefing on Plaintiff's other argumentsthat causation can be established through Dr. Engelhard, and Plaintiff's injuries do not require expert testimony to establish causation. To help expedite the Court's review of the latter argument, the Court requests that by May 29, 2024, Plaintiff file a chart that concisely describes the following: (i) Plaintiff's claimed injury; (ii) whether Plaintiff believes expert testimony is required to establish causation for this injury; (iii) which witnesses Plaintiff intends to call to discuss the injury, and whether those opinions are lay or expert; (iv) whether there is any evidence the injury was pre-existing (with citations to the evidence); and (v) whether there is any evidence regarding the relationship between the pre-existing injury and the claimed injury. Plaintiff is directed to provide her version of the chart to Defendant by May 20, 2024, so that Defendant has an opportunity to insert its responses to Plaintiff's positions using the same columns.
