Order on Motion for Extension of Time to File
This matter is before the Court on Plaintiff's Third Unopposed Motion for Extension of Time to Disclose Experts and Modify Scheduling Order [# 32 ] ("Third Motion"). The Third Motion was filed on June 22, 2026, 17 days after Plaintiff filed the Second Motion [# 29 ] and 15 days after the Court granted Plaintiffs Second Motion. Plaintiff now seeks to further extend the deadlines by another 30 days because "Plaintiff's counsel is currently in trial preparation for a trial beginning July 6, 2026[.]" Third Motion [# 32 ] at 2. Counsel was presumably aware of the upcoming trial when she filed the Second Motion [# 29 ], which primarily relied on the recent disclosure of 436 pages of claim file documents. While the Court will grant the Third Motion's requested extensions, no further extensions of these deadlines will be granted absent exceptional circumstances. Accordingly, it is ORDERED that the Third Motion [# 32 ] is GRANTED. Plaintiff's affirmative expert disclosures are now due July 30, 2026. Defendants affirmative expert disclosures are due August 30, 2026. The parties rebuttal expert disclosures are due September 20, 2026. Fed. R. Evid. 702 motions are due October 20, 2026.
