///ORDER granting 36 Motion to Dismiss for Failure to State a Claim; granting 61 Motion to Dismiss for Failure to State a Claim; denying as moot 81 Motion for Discovery on Remand; denying 90 Motion for Hearing; denying 104 Motion to Amend Complaint; denying 105 Motion to Amend; denying as moot 107 Motion for Recusal of Chief Judge Samantha. D. Elliott. For the foregoing reasons, Anderson's motion for a hearing (doc. no. 90), Bisasor's motion for recusal (doc. no. 107), and the plaintiffs' motions for leave to file a second amended complaint (doc. nos. 104 & 105) are denied. The Donais Defendants' motion to dismiss (doc. no. 36) and the Hilliard Defendants' motion to dismiss (doc. no. 61) are granted. The court sua sponte dismisses Count 31 for lack of jurisdiction.
