MINUTE ORDER issued by Relief Courtroom Deputy for District Judge Dale A. Drozd on 7/27/2026: The court hereby CLARIFIES the 33 minutes regarding the hearing held on 7/27/2026. At the hearing, the court did not address the reopening of fact discovery and accordingly did not consider plaintiff's 13 motion to reopen discovery. On 1/29/2026, the court 14 directed plaintiff to file a certification that he had exhausted meet and confer efforts regarding resolution of his 13 motion to reopen discovery and informed plaintiff that failure to file that certification within ten (10) days of the date of that order may result in denial of plaintiff's 13 motion for failure to comply with the court's requirements. To date, plaintiff has not filed that certification and the time in which to do so has passed. Accordingly, the court hereby DENIES plaintiff's 13 motion to reopen fact discovery. This order does not impact the court's other orders at the 7/27/2026 hearing regarding the reopening of expert discovery and related motions deadlines. MINUTES (Text Only) for PRETRIAL CONFERENCE held via video conference before District Judge Dale A. Drozd on 7/27/2026: The court and parties discussed the status of the case. Rebecca Neubauer attorney for Plaintiff, present. Meredith Montrose, attorney for Defendant, present. Tyler Kirsch, attorney for non-party lienholders, present. The Court GRANTED 13 Plaintiff's Motion for Extension of Time, 19 Plaintiff's Motion for Discovery; and 21 Plaintiff's Motion to Amend the Scheduling Order. The Court DENIED 18 Defendant's Motion for Sanctions. The court VACATED the 7/27/2026 Trial Confirmation Hearing and 9/29/2026 Jury Trial, both to be re-set as soon as practical. The parties were DIRECTED to meet and confer regarding a new schedule to complete expert discovery and related law and motion; contact the Courtroom Deputy regarding available dates for a Final Trial Confirmation Hearing and Jury Trial; and file a proposed schedule.
