Defendant/Counter-Plaintiff's Request for Oral Argument (Doc. 23) is DENIED as moot. Plaintiff/Counter-Defendant's Motion for Summary Judgment (Doc. 25) is DENIED. The Clerk is directed to enter judgment in favor of Plaintiff/Counter- Defendant National Transportation Insurance Company and against Defendant/Counter-Plaintiff Richard Varn on all claims in the Complaint (Doc. 1) and Counterclaims (Doc. 12), declaring that the obligations and requirements laid out in the MCS-90 Endorsement attached to National's certificate number MDX-22-203444-00 have not been triggered, and National has no obligation to pay the Consent Judgment against 21 Auto in Varn v.
