EO: The Court has carefully reviewed the parties' 137 proposed Stipulation to Extend Non-Dispositive Motions and Pretrial Deadlines ("Proposed Stipulation"), which seeks to (1) continue KPRS' non-dispositive motions deadline from August 7, 2026 to August 24, 2026; (2) continue the parties' deadline to file motions in limine from August 17, 2026 to August 31, 2026; (3) continue the parties' deadline to file oppositions to motions in limine from August 24, 2026 to September 8, 2026; and (4) continue all other pretrial deadlines set forth in the Court's Second Amended Rule 16 Scheduling Order for a period of 30 days.
The Court DENIES the Proposed Stipulation for lack of good cause shown. The Court entered the Second Amended Rule 16 Scheduling Order on March 13, 2026. ECF No. 103. Since then, the Court twice continued certain pretrial deadlines at the parties' request. See ECF Nos. 113, 126. None of the current deadlines are a surprise to the parties, and the Court finds that the current deadlines can all be met with appropriate diligence. See Johnson v. Mammoth Recreations, Inc., 975 F.2d 604, 609 (9th Cir. 1992) ("district court may modify the pretrial schedule if it cannot reasonably be met dispute the diligence of the party seeking the extension" (internal quotation marks and citations omitted)); see also Local Rule 16.1 ("All counsel and self-represented litigants shall proceed with diligence to take all steps necessary to bring an action to readiness for trial.").
