Re: 167 Proposed Protective Order.
The United States has filed a proposed protective order. However, it suffers from two deficiencies.
First, it is simply filed as a protective order. Not a motion or stipulation. But under Federal Rule of Civil Procedure 7(b), requests for court orders must be made by motion.
Second, the proposed order is not signed by counsel as required by Federal Rule of Civil Procedure 11.
Additionally, it is not entirely clear why the United States requires the Court's involvement to treat certain documents as confidential. Parties are permitted to agree to discovery procedures, including confidentiality protections, without judicial approval. See Fed. R. Civ. P. 29(b); see also Cross v. Walmart, Inc., 350 F.R.D. 395, 398-99 (D. Nev. 2025). The proposed protective order does not explain in meaningful fashion why judicial oversight is required.
IT IS THEREFORE ORDERED that the proposed protective order (ECF No. 167 ) is DENIED WITHOUT PREJUDICE.
