   ORDER: After careful review of the file and upon consideration of the recommendation of the Magistrate Judge, it is ORDERED as follows: 1) The court ADOPTS the recommendation of the Magistrate Judge (doc. 119 ) as modified herein. 2) The motion to dismiss (doc. 69 ) filed by the Chambers County Board of Education is GRANTED IN PART and DENIED IN PART. 3) The motion to dismiss (doc. 78 ) filed by the City of Valley, Mayor Riley, Chief Reynolds, the Defendant Officers (Chris Daniel, Christopher C. Davis, Lorenzo Harris, Michael Meacham, Stacy Shirey, and David G. Smith), and Jail Watch Commander Spruill is GRANTED IN PART and DENIED IN PART. 4) The motion to dismiss (doc. 86 ) filed by BOE President Finch is GRANTED. 5) The motion to dismiss (doc. 102 ) filed by Superintendent Chambley is GRANTED IN PART and DENIED IN PART. 6) Plaintiffs' motion for partial summary judgment (doc. 95 ) is DENIED. 7) Count I is DISMISSED on grounds that Chief Reynolds and the Defendant Officers are entitled to qualified immunity. 8) Count II is DISMISSED IN PART as follows: a. As to the retaliatory arrest claim against Chief Reynolds and the Defendant Officers on grounds of qualified immunity. b. As to the retaliatory arrest claim against Mayor Riley for failure to state a claim upon which relief can be granted. c. As to the retaliatory arrest and employment retaliation claims against BOE President Finch for failure to state a claim upon which relief can be granted. d. As to Smith's employment retaliation claim against Superintendent Chambley for failure to state a claim upon which relief can be granted. 9) Count IV is DISMISSED as to BOE President Finch. 10) Counts V and VI are DISMISSED for failure to state a claim upon which relief can be granted. 11) Count VII is DISMISSED on grounds that Chief Reynolds and the Defendant Officers are immune under state law. 12) Count VIII is DISMISSED on grounds that Chief Reynolds, the Defendant Officers, and Jail Watch Commander Spruill are immune under state law. 13) Count IX is DISMISSED as to BOE President Finch. 14) BOE President Finch and Jail Watch Commander Spruill are dismissed from this action, as no claims remain against them. 15) This matter will proceed on the following remaining claims: a. Count II as to the retaliatory arrest claim against Chambley. b. Count III against the City of Valley and the BOE. c. Count IV against Riley, Chambley, Reynolds, and the Defendant Officers. d. Count IX against Riley, Chambley, Reynolds, the BOE, and the City of Valley. 16) This case is REFERRED BACK to the Magistrate Judge for further determination and recommendation as may be appropriate.
