Minute Entry for proceedings held before Judge Nina R. Morrison: A video pre-motion conference ("PMC") was held on September 8, 2026 at 2:30 P.M. Ryan Miller appeared on behalf of Plaintiffs. Laura Dowgin and Alexandra Smith appeared on behalf of Defendant. Pursuant to the Court's Individual Rule 5.1.4, the Court construed the parties' 6 and 8 PMC letters concerning Defendant's anticipated motion to dismiss as the motion itself. For the reasons stated on the record, the Court conditionally denied Defendant's motion with respect to Plaintiffs' first, second, and third causes of action. As discussed on the record, by September 15, 2026, the parties shall file a joint letter indicating whether Defendant wishes to file a supplemental brief alerting the Court to any factual or legal matters it believes the Court may have misapprehended or overlooked in its conditional ruling; how Plaintiffs wish to proceed with respect to their fourth cause of action; and whether the parties seek a referral to mediation or to a settlement conference before the Magistrate Judge.
