Initial Conference Hearing ~Util - Set Deadlines/Hearings
Minute Entry for Initial Conference proceedings held on 6/23/2026 before Magistrate Judge James R. Cho. Appearances by Amy J. Kallal for plaintiff; Roman Rabinovich and Jason Michael Fratus for defendant.
Case discussed. By 7/24/2026, plaintiff shall provide defendants with a redlined version of its proposed amended complaint. By 7/31/2026, if defendants consent, plaintiff shall file its amended complaint, otherwise plaintiff shall file its motion seeking leave to amend the complaint in accordance with the District Judge's Individual Practices.
The Court entered the following pre-trial schedule: parties shall serve initial disclosures by 6/30/2026; no amendment of the pleadings or joinder of additional parties permitted after 9/30/2026 without good cause; and parties to complete fact discovery by 12/18/2026. The Court anticipates setting an expert discovery schedule after the parties have completed fact discovery.
Plaintiff anticipates filing a Rule 12(c) motion for judgment on the pleadings and seeking a stay of discovery. Parties shall meet and confer regarding production of plaintiff's claims and underwriting files.
Telephonic status conference scheduled for 8/12/2026 at 10 a.m. before Magistrate Judge James R. Cho. Each party is directed to call 571-353-2301 and enter Meeting ID 709-478-501#.
