TEXT ONLY NOTICE - Counsel the Court has been advised that the parties, apart from Dr. Bigelow and Jackson Hole Medical Imaging PC have reached a settlement of all their claims in this case. Thus, the only pending motion for summary judgment is that of Dr. Bigelow and Jackson Hole Medical Imaging PC (ECF No. 115). The Court is currently conducting a bench trial, but so the parties can prepare accordingly, the Court advises the parties that it will be issuing a written order DENYING Defendant Dr. Bigelow and Jackson Hole Medical Imaging PC's Motion for Summary Judgment tomorrow. Separately, the parties are hereby advised that the Court finds that given the nature and extent of pretrial proceedings, judicial economy, convenience, and fairness are served by retaining supplemental jurisdiction over this remaining claim. See Tufaro v. Oklahoma ex rel. Board of Regents of University of Oklahoma, 107 F.4th 1121, 1141 (10th Cir. 2024). Thus, the trial will proceed on the remaining claim as scheduled. (Court Staff, scat)
