Initial Conference Hearing Order on Motion for Leave to Proceed In Forma Pauperis
Minute entry for proceedings held before Magistrate Judge Clay H. Kaminsky: An initial conference was held in-person on July 29, 2026. Madeleine Reichman and Pavita Krishnaswamy appeared on behalf of plaintiff; Daniel Corrigan appeared on behalf of the Community Preservation Corporation; Evan Richards appeared on behalf of all other defendants. For the reasons stated on the record, the Plaintiffs' amended motion for leave to proceed in forma pauperis 22 and motion for protective order 27 were granted. Following a discussion of the case and the parties' proposed discovery plan, the Court set the below deadlines:
Rule 26(a)(1) productions shall be completed by August 14, 2026.
The parties shall write to the Court concerning an ESI protocol by August 31, 2026.
The parties shall serve initial interrogatories and requests for production by August 31, 2026, 2026.
No amendment of the pleadings will be permitted and no additional parties may be joined after August 31, 2026.
Fact discovery shall be completed by January 29, 2027.
The parties shall make required Rule 26(a)(2) disclosures for affirmative expert witnesses on or before February 28, 2027, and for rebuttal expert witnesses on or before March 31, 2027, and for all expert discovery must be completed by April 30, 2027.
The deadline to take the first step in dispositive motion practice is June 1, 2027.
No extension of the above deadlines will be granted except upon a motion, filed prior to the deadline and consistent with Judge Kaminsky's Individual Practices and Rules, showing good cause for the extension. The parties are reminded that "a finding of 'good cause' depends on the diligence of the moving party." Parker v. Columbia Pictures Industries, 204 F.3d 326, 340 (2d Cir. 2000).
