ORDER re 46 Notice of Voluntary Dismissal; granting 47 Motion to Stay; denying 23 Motion to Compel; finding as moot 25 Motion to Dismiss.The Court GRANTS the parties' joint motion to stay this case through 2/1/27. Second, Plaintiffs Bogart and Crews have filed a Notice of Voluntary dismissal seeking to dismiss their claims against Defendant pursuant to Rule 41(a)(1)(A)(i) of the Federal Rules of Civil Procedure. (Doc. 41). However, Rule 41 allows for voluntary dismissals only under certain circumstances. The rule is limited to dismissals of "actions," not "parties" or "claims," meaning that the rule cannot be used to cleave away one claim or one party from a larger case. See Taylor v. Brown, 787 F.3d 851, 857-58 (7th Cir. 2015). The Seventh Circuit is clear that to dismiss one claim or one party from an action that will otherwise continue, a plaintiff must instead file an amended complaint. While the Court acknowledges the plain reading of Rule 41, it finds that in this limited instance, given the procedural posture of this case, judicial economy counsels in favor of allowing dismissal of Plaintiffs Bogart's and Crews' claims without prejudice. Dismissal of these claims also renders Defendant's Motion to Dismiss as to these same claims MOOT. (Doc. 25). Finally, because the case will be stayed pending mediation and because the parties have agreed not to pursue arbitration until after mediation is completed, the Court DENIES without prejudice Defendant's Motion to Compel Arbitration.
