Magistrate Judge M. Page Kelley: ORDER entered. The Fed. R. Civ. P. 12(b)(3) motion to dismiss Larrimore should be allowed to the extent that it seeks a venue transfer. Dr. Larrimore should be permitted seven (7) days from the adoption of the report and recommendation to state the district she wishes the court to transfer her action to pursuant to 28 U.S.C. § 1391(b)s requirements. Compare, e.g., Krick, 695 F. Supp. 3d at 220. The Fed. R. Civ. P. 12(b)(6) motion to dismiss Count VI should be denied as moot given Dr. Larrimores voluntary dismissal of that RICO claim. The Fed. R. Civ. P. 12(f) motion to strike allegedly irrelevant and scandalous allegations from the complaint is denied without prejudice. Objections due 8/31. (SP)
