MINUTES (IN CHAMBERS) ORDER RE DEFENDANT'S MOTION TO COMPEL ARBITRATION 9 by Judge Wesley L. Hsu. Here, aside from asserting that Plaintiff was "required to agree to all terms and conditions" of the BAPA and that Plaintiff was "sent electronic notice[s]" of subsequent BAPA versions (see generally Newton Decl.), Defendants attach no supporting evidence of the "clickwrap" agreement that was presented to Plaintiff at the time of his account opening that placed him on notice of the terms that would bind him. Accordingly, the Court finds Defendants failed to meet their burden of proof as to assent and DENIES the Motion without prejudice. The hearing calendared for July 10, 2026, is hereby VACATED.
