Order on Motion to Stay
MINUTE ORDER denying 9 appellants' renewed emergency motion for stay pending appeal. The Court will not stay ongoing proceedings in the bankruptcy case just because appellants have appealed certain orders previously issued by the Bankruptcy Court, even if those orders do go to the merits of the claims underlying the sanctions proceedings that are the subject of this motion. Appellants posit that it would be more efficient to have the appeal proceed first, but they have not made the showing necessary to grant a stay, including that they will suffer irreparable harm if the hearing goes forward. Moreover, if the motion for sanctions is granted by the Bankruptcy Court, it is extremely likely that such a ruling will be appealed, and it will be considerably more efficient to handle all of appellants' appeals at once and not piecemeal.
