(IN CHAMBERS) ORDER RE JOINT STATUS REPORT by Judge John A. Kronstadt: In the June 23, 2026, Joint Status Report ("Report" (Dkt. 45 )) filed by the parties, they stated that they had finalized a "Memorandum of Understanding," as to a settlement, and were negotiating the terms of "a long-form settlement agreement." The Report also stated that Plaintiffs "intend to seek approval of the settlement, within the next ninety (90) days." It also states that Plaintiff intend to file an Amended Complaint in Casey Adler v. Volume Services, Inc, San Diego Superior Court, No. 25CU046642N to consolidate there, this action, Casey Adler, et al. v. Volume Services, Inc., et al., No. 2:26-CV-1174-JAK (C.D. Cal.) and others, and then dismiss this action in its entirety without prejudice. Although more than 90 days have passed since the Report was filed, there have been no further filings as to the foregoing matters. Accordingly, on or before October 13, 2026, the parties shall file an updated joint status report as to the foregoing matters, including as to the potential request to dismiss this action without prejudice, and the expected date by which they will do so, and whether they also intend to seek the dismissal of Maria C. Garcia v. Volume Services, Inc., No. 2:25-CV-5964-JAK (C.D. Cal.). Based on a review of the updated report, a determination will be made whether to schedule a status conference.
