Denial was without prejudice to refiling as an agreed motion as to an amended complaint that would clarify the current procedural and party posture. Plaintiff may bring an opposed motion if necessary, if agreement isn't reached. The Court addressed the motion to sever the cross-claim. Dkt 97. It was DENIED AS MOOT. The Court addressed the motion for entry of final judgment pursuant to Rule 54(b) of the Federal Rules of Civil Procedure. Dkt 107. It was TAKEN UNDER ADVISEMENT. Defendants were ORDERED to provide to the Case Manager by May 13, 2024, any cases demonstrating that entry of final judgment as to an indemnification ruling is an appropriate case for exercise of discretion under Rule 54(b). The Court addressed the motion for status conference. Dkt 105. It was TERMINATED AS MOOT. The Court addressed potential for settlement.
