DOCKET TEXT ORDER denying 350 Plaintiff's Motion for Leave to File Sealed Document. Plaintiff seeks to seal portions of Exhibits 5, 6, and 20 to his 347 opposition to Defendants' 330 motion for summary judgment. Plaintiff states the redacted portions contain confidential information regarding the expunged criminal record of a nonparty, citing the court's order 179 permitting certain records related to this expunged criminal history to be designated "confidential" under the Standard Protective Order. For the reasons stated in the May 15, 2024 memorandum decision order 368 regarding Defendants' 338 motion to seal, reliance on the prior order is misplaced; the prior order does not address whether such information should remain sealed when filed in connection with substantive motions. Further, the specific information redacted from Exhibits 5, 6, and 20 is now in the public record in this case, where the same information is discussed in the parties' public summary judgment briefing. Accordingly, Plaintiff has not demonstrated the redacted portions warrant sealing. The unredacted versions of Exhibits 5, 6, and 20 (Doc. Nos. 353, 354, and 355) shall be unsealed. DOCKET TEXT ORDER granting in part 340 Defendants' Motion to Seal Exhibit 9 to Plaintiff's 329 Motion for Partial Summary Judgment. Exhibit 9 (Doc. No. 331-9) contains similar copies of the same documents in Exhibit HH to Defendants' 330 Motion for Summary Judgment. In its May 15, 2024 order 368 , the court granted in part Defendants' motion to seal Exhibit HH, and ordered Defendants to refile the first two pages of the exhibit publicly. Defendants' motion to seal Exhibit 9 is likewise granted in part for the same reasons stated in the prior order. Provided Defendants refile the first two pages of Exhibit HH as ordered, no further action is needed with respect to Exhibit 9. However, Plaintiff may refile the first two pages of Exhibit 9 publicly if he so chooses. The original version of Exhibit 9 filed at docket number 331-9 shall remain sealed until otherwise ordered.
