SkyKick Fights To Overturn Sky TM Infringement Win
Law360, London (May 26, 2021, 4:08 PM BST) -- Software developer SkyKick urged a London appeals court on Wednesday to overturn a ruling that it had infringed Sky's trademarks for its cloud-based email migration and backup services, saying a judge had mismatched the British broadcaster's trademark registrations with its technology products.
Simon Malynicz QC of Three New Square, representing SkyKick, told the Court of Appeal that the lower court judge's infringement ruling construed Sky's trademarks too broadly. Malynicz spoke at the second day of a hearing before the Court of Appeal that is set to last three days, with both sides challenging elements of two rulings made by Judge Richard Arnold.
