A Kentucky woman alleging General Motor LLC's ignition switch defect caused her 2013 car crash told a New York federal judge on Thursday that the automaker should not be allowed to suggest she is a drug addict during her bellwether trial.

The New York federal judge overseeing bellwether trials over GM's ignition-switch defect said on Wednesday that New GM can retry the question of whether Old GM should have known about the defect before its 2009 bankruptcy, rejecting a driver's bid to hold off on a redo.

General Motors intends to ask the U.S. Supreme Court to review a Second Circuit decision that opened it to liability claims related to ignition switch defects if the full appeals court doesn't modify or reverse the decision, according to a joint statement the parties in a New York product liability class action sent to the judge Monday.
