JUDGMENT: NOW, THEREFORE, IT IS HEREBY ORDERD, ADJUDGED, AND DECREED: The First Confirmation Order and the Second Confirmation Order are VACATED only insofar as they confirmed the Awards as binding upon, or as precluding the judicial pursuit of s tatutory claims by, any of the Named Appellants and the classes they seek to represent, as determined by the state courts. The Awards otherwise remain binding consistent with the First Confirmation Order and the Second Confirmation Order. As further set forth in this Order. This Judgment shall be without prejudice to further proceedings in state court actions including any determination by those state courts as to class certification. The Clerk of Court is directed to enter judgment accordingly and upon entering judgment, shall close this action. SO ORDERED. (Signed by Judge John G. ORDER: The Court has carefully considered the proposed judgments by the various parties. It has entered a judgment that embodies the directions of the Court of Appeals. It confirms the First and Second Arbitral Awards except as to the Appellant Int ervenors, and as to those parties it allows the state courts to determine the ability of those parties to recover for themselves and any class the state courts may deem appropriate. It is unnecessary to include all of the qualifications that the part ies seek to impose on the proposed judgment, including the various reasons that various Intervenor Appellants may not be able to recover. The Court of Appeals left those determinations to the state courts and this Court should not attempt to modify or explain the opinion of the Court of Appeals. SO ORDERED. (Signed by Judge John G.
