INDICATIVE ORDER: The Court hereby indicates pursuant to Rule 62.1 that if the Federal Circuit remands the case, it will grant a joint motion for relief under Rule 60(b) thereby vacating and modifying the portion of the Final Judgment (D.I. 393 ) precluding the FDA from granting final approval of Ascents ANDA products until after expiration of the infringed patentsleaving all other aspects of the Final Judgment intactwhich is the only remaining obstacle to effectuation of the settlement between the parties, as set forth in the Joint Stipulation and Proposed Order presented by the Parties in connection with their Joint Motion for an Indicative Order.
