ENDORSED ORDER: On August 12, 2026, Plaintiff's counsel left a voicemail for Judge Flynn's law clerk advising that the case had "settled a little over a week ago." This was the first time counsel informed the Court of the case's resolution. During the past week, the Court unnecessarily expended significant resources reviewing and ruling on two Daubert motions filed by Defendant Coloplast Corp. (Doc. # 89; Doc. # 90; Doc. # 145; Doc. # 146). That time could have been used to work on other pending matters. Pursuant to Local Rule 3.09(a), "[t]he parties must immediately file a notice after agreeing to resolve all or part of a civil action, even if the resolution is contingent or unwritten." Local Rule 3.09(a). Accordingly, the parties are directed to show cause by August 19, 2026, why sanctions should not be imposed for failing to immediately notify the Court of the case's resolution as required by Local Rule 3.09(a).
