Order Adopting Report and Recommendations Order on Report and Recommendations
ORDER ADOPTING REPORT AND RECOMMENDATIONS. On July 20, 2026, United States Magistrate Judge James M. Wicks issued a 93 Report & Recommendation (the “R&R”) recommending that Lead Plaintiff’s 78 Motion for Preliminary Settlement Approval be Granted, and that various conditions as set forth in 93 be ordered. On July 29, 2026, 94 the parties filed a letter noting that they do not object to the R&R and requesting that the Court adopt it and enter the Proposed Preliminary Approval Order e-filed as [78-7].
Under Second Circuit precedent, “[i]f a party fails to properly object to the R&R, the district judge reviews the R&R only for clear error.” Nambiar v. Cent. Orthopedic Grp., LLP , 158 F.4th 349, 359 (2d Cir. 2025) (citing Fed. R. Civ. P. 72(b)). Clear error exists “where, upon a review of the entire record, [the district judge] is left with the definite and firm conviction that a mistake has been committed.” Saveria JFK, Inc. v. Flughafen Wien, AG, No. 14-cv-6195, 2017 WL 119456, at *2 (E.D.N.Y. Mar. 30, 2017). In accordance with that applicable clear error standard of review, the Court has carefully reviewed the R. & R., and has found it to be correct, well-reasoned, and free of any clear error. See Dafeng Hengwei Textile Co. v. Aceco Indus. & Com. Corp. , 54 F. Supp. 3d 279, 283 (E.D.N.Y. 2014).
The Court, therefore, adopts the R&R in its entirety as the opinion of the Court. Accordingly, the 78 Motion for Preliminary Settlement Approval is granted, the Court approves the subject settlement, and the Court enters the accompanying Proposed Preliminary Approval Order.
