Order on Motion to Withdraw
ORDER denying 186 Motion to Withdraw Answer. Defendant Karl seeks to withdraw her answer, filed when she was proceeding pro se, in favor of filing a motion to dismiss under Federal Rule of Civil Procedure 12(b) at the appropriate time. As she recognizes, there is no applicable rule pertaining to withdrawing a responsive pleading such as an answer. But because Defendant Karl retains the ability to file a motion for judgment on the pleadings under Rule 12(c) at any time after the pleadings are closed, but early enough not to delay trial, the Court finds that she need not withdraw her answer in order to advance arguments for dismissal. Thus, it denies her motion. As the Court has now determined that it will not stay Plaintiff's claims insofar as they seek monetary damages -- at least for purposes of deciding the pending motions to dismiss -- Defendant Karl may move under Rule 12(c) should she wish for her dismissal arguments to be considered along with the other Defendants' motions to dismiss.
