Oral Order ~Util - Set Deadlines/Hearings
ORAL ORDER: The court will hold a brief hearing on Thursday, August 6, 2026, at 2 p.m. Eastern Time via Zoom to address two issues relating to Dentsply's pending Motion to Dismiss, D.I. 14 . The parties should be prepared to address (1) whether infringement of the '173 patent by the obturators has been adequately pleaded, specifically with regard to the three tapered portions of equal length limitation, and (2) whether Guidance has in fact licensed the asserted patents and sufficiently pleaded compliance with the marking statute as it relates to any licensees. The parties will be jointly responsible for obtaining court reporting services for the hearing. The sign-in information will be sent to counsel by email in advance of the hearing.
