ORDER granting 31 -- Considering the factors set forth in Chesney v. Valley Stream Union Free Sch. Dist. No. 24, 236 F.R.D. 113, 115 (E.D.N.Y. 2006) and reiterated in Amron v. 3M Minnesota Mining & Mfg. Co., No. 23 CV 8959, 2024 WL 263010, at *2 (E.D.N.Y. Jan. 24, 2024), the Court finds that there exists good cause to stay discovery pending resolution of the anticipated motion to dismiss. First, Defendants raise threshold arguments that, if successful, could result in dismissal of this action. Second, although Plaintiffs claim that discovery "appears limited in time and scope," the Complaint brings class allegations "on behalf of...the estimated thousands or millions of similarly situated consumers." The Complaint alleges that Defendants own at least 10 brands and several consumer retail outlets. Discovery in this matter could encompass a voluminous number of documents and potentially burdensome search into, inter alia, Defendants' pricing decisions and historic pricing across several retail brands, their compliance with tariffs and international trade laws, and the related litigation in the United States Court of International Trade. Moreover, considering the potential for consolidation into a multidistrict litigation in the Northern District of Illinois (see Dkt. Nos. 34 , 35 ), pursuing discovery at this stage would not serve to promote efficiency. Third, Plaintiffs have not demonstrated any prejudice that would be suffered by staying discovery. Indeed, they state that "neither brevity nor lack of prejudice is certain here." (Dkt. No. 33 at 3). As such, discovery is hereby stayed pending resolution of Defendants' anticipated motion to dismiss. Ordered by Magistrate Judge Peggy Cross-Goldenberg on 9/11/2026. (JST)
