Plaintiff's design defect claim is dismissed with prejudice, and the remaining claims are dismissed without prejudice until and if Pla intiff can sufficiently allege that Defendants acquired new information with enough time to use the CBE regulation for a label change, prior to withdrawing the medication form the market and that she can overcome the learned intermediary doctrine. F or the claims dismissed without prejudice, Plaintiff is granted leave to amend her Complaint within 30 days if she has a good faith basis for believing she can cure the pleading deficiencies identified in this Opinion. If Plaintiff does not file her amended complaint within 30 days from the date of this Opinion, Plaintiff's case will be dismissed with prejudice.
