The court adopts the dates in the joint-proposed schedule, see 56 , in that: the deadline to amend pleadings, except for good cause shown, is September 18, 2026; the fact discovery deadline is February 5, 2027; the expert discovery deadline is April 16, 2027; and the deadline to file dispositive and/or Daubert motions is May 27, 2027, with oppositions to those motions due June 28, 2027. The court will schedule a status conference following the end of fact discovery. See 56 for remaining deadlines.
If, for example, the parties need to conduct a deposition after a deadline and they are in agreement, they do not need to seek the court's permission to conduct the deposition late. Moreover, if they are in agreement, the parties may seek to resolve discovery disputes informally by jointly emailing Deputy Clerk Vieira (Leonardo_Vieira@mad.uscourts.gov) and briefly describing the dispute and requesting a hearing. If either party wishes to engage in formal motions practice to resolve a discovery dispute, however, they must do so.
Finally, the parties may at any time seek referral to the Court's mediation program by jointly emailing Deputy Clerk Vieira. They may specify a preferred mediator and should specify convenient dates for the mediation. The court will suspend the deadlines to permit the parties to engage in mediation, through the Court's program or privately.
