ORAL ORDER re 240 & 265 - Having reviewed Element's two Motions for Conference to Resolve Discovery Dispute, IT IS HEREBY ORDERED that an in-person hearing is set for September 18, 2026 at 10:00 AM before Judge Eleanor G. Tennyson in Courtroom 2B. Each side will be limited to twenty (20) minutes of argument. Lead trial counsel (i.e., the persons trying the case) must be present at this hearing, and the parties shall be prepared to meet and confer in person at the hearing prior to the Court taking any action. On or before 11:00 AM on August 28, 2026, Element shall file with the Court a letter not to exceed four (4) pages in no less than 12-point font outlining the issues in dispute and its position on those issues. Element shall attach to its letter a draft order that identifies with specificity the relief sought by that party on an issue-by-issue basis. On or before 11:00 AM on September 4, 2026, Illumina may file a letter not to exceed four (4) pages in no less than 12-point font outlining its opposition. All letters shall comply with the requirements of Local Rule 37.1. IT IS FURTHER ORDERED that the parties shall not file any further discovery motions prior to this hearing or raise in their letter briefing any new discovery issues. ORDERED by Judge Eleanor G.
