Order on Motion for Protective Order
Judge Myong J. Joun: ELECTRONIC ORDER entered. MGB’s motion for a protective order, Doc. No. 19 , is GRANTED. Judicial review of an ERISA benefits determination is presumptively limited to the administrative record, absent a “very good reason” for additional discovery. Plaintiff seeks a Rule 30(b)(6) deposition concerning MGB’s evaluation of the medical, vocational, and Social Security evidence underlying its benefits determination. MGB represents that this information is contained in the administrative record. Plaintiff has not identified a sufficient conflict, procedural irregularity, or other basis warranting extra-record discovery. Accordingly, the Rule 30(b)(6) deposition notice, including Schedule B, is QUASHED. The case shall proceed on the administrative record. (SP)
