TEXT ORDER: This matter comes before the Court upon review of the parties' statements regarding lifting of the automatic stay. (ECF Nos. 41 , 42 .) Appellant is directed to file supplemental briefing within thirty (30) days of this Text Order addressing: (1) why the injunctive provisions of the Second Amended Joint Chapter 11 Plan of Reorganization of New Rite Aid, LLC and its Debtor Affiliates (Technical Modifications) (Plan) (ECF No. 3445, Ex. A, Bk. No. 25-14861), specifically Articles X.A. and X.F, do not apply such that Appellant is not enjoined from continuing this appeal; (2) why a finding by this Court that an injunction is in effect would amount to the nonconsensual release of Appellant's potential claims against third parties unrelated to the RADII Debtors or their affiliates; and (3) why relief from this Court is necessary in light of Article X.F of the Plan, especially Article X.F ¶ 2, which permits Appellant to pursue third-party claims not otherwise barred by Article X.F upon approval by the Bankruptcy Court.
