ORDER GRANTING FINAL DISTRIBUTION OF SETTLEMENT FUNDS (Doc. 78) by Judge Josephine L. Staton, re Status Report 78 : The Court has reviewed Plaintiff's Post-Distribution Status Report (Doc. 78), the Post-Accounting Declaration of Settlement Administrator Simpluris, Inc. attached as Exhibit A thereto, and the Court's Post-Distribution Accounting form, attached thereto as Exhibit B. The Court finds that redistribution of the $3,087.49 in unclaimed funds is economically infeasible and orders those funds released to the cy pres designee, the International Association of Privacy Professionals. The Court further finds that, with the remaining $280,520.52 in payments having been cashed or redeemed by those Class Members who submitted claims for relief, the 10 percent in attorneys' fees withheld pending distribution of the Settlement funds to Class Members are ordered released to Plaintiff's counsel.
