MINUTE ORDER IN CHAMBERS of the Honorable Judge Richard F. Boulware, II on 9/30/2026.
Upon its review of Plaintiff's 82 and 89 Motions for Reconsideration, the Court finds there was no clear error regarding the Court's 78 Order as it relates to the Court dismissing Plaintiff's claims against Overstock.com, Inc. or as it relates to service of process. See Local Rules 59-1(a)-(b); see also 389 Orange Street Partners v. Arnold, 179 F.3d 656, 665 (9th Cir. 1999) (Motions for reconsideration "should not be granted, absent highly unusual circumstances, unless the district court is presented with newly discovered evidence, committed clear error, or if there is an intervening change in the controlling law."). Based upon that finding,
IT IS ORDERED that Plaintiff's 82 and 89 Motions for Reconsideration are DISMISSED with prejudice.
IT IS FURTHER ORDERED Plaintiffs 75 Motion to Demand is DENIED without prejudice as moot as the parties have already both requested a jury trial.
